生命倫理學中，「墮胎」是有關「胎兒生存權與女性身體自主權」在
選取決定上的道德衝突之重要議題，基於女性主義主張女性應擁有生
育自由，「墮胎」向來更是女性主義關切的主要論題之一。傳統上，
對「墮胎」的探討可分為支持、反對以及折衷三派的不同立場，而產
生爭議的主因在於各派對胎兒與女性的道德地位各有不同的判準，以
致與二者相應的道德權利自有不同。因此，本文在研究中除了釐清「墮
胎」議題有關「價值」和「權利」的爭議之外，為能解決判準不一致
的問題，嘗試以自由女性主義主張的「道德行動者」為判準，並與基
進女性主義和主張關懷倫理的不同女性主義派別進行論說對照之
後，發現自由女性主義的論點在胎兒與母親之間的道德關聯思考上仍
有不夠周延之處，是以，提出「道德人格」修正「道德行動者」之判
準在道德表現的不足，以使「道德行動者」得以依據「不忍人之心」
在胎兒—母親人倫關係上，給予「胎兒生存權」充分的道德考量，同
時，依據「仁心」的道德原則給出「女性身體自主權」之主張的道德
根源，在此意義下，自由女性主義對墮胎的觀點可獲得充分且必要的
證成。如此，則能達成本文研究期望--通過對墮胎道德的探討，提出
女性主義的觀點與建議判準，減少墮胎發生的可能；在無可避免時，
以建議之判準能夠有助於進行墮胎選取之倫理分析，解決墮胎的道德
爭議。
