Abstract:	摘要鑑於工程實務界因工程設計未盡完備，圖說文件不盡詳實，契約規範不儘公平等問題，往往導致工程疑（爭）議迭起，甚至造成施工進度遲延，影響工程品質等問題，亟待改善。因此如何妥善防制工程設計瑕疵的再發生，實為值得研探討究之課題。本研究乃藉由相關文獻資料之蒐集與整理，瞭解工程設計文件之內涵及設計者之權利義務和法律責任；其次藉由彙整工程設計問題相關研究調查結果與糾紛案例等資料，深入瞭解與分析工程設計文件瑕疵問題之現況，以設計者觀點找出工程設計文件瑕疵發生的原因，以確認國內現行工程設計文件瑕疵的態樣。根據本研究之檢討與分析，目前國內設計文件仍存在設計錯誤、遺漏設計、設計不完整、數量表漏列、圖與圖衝突、圖與說不符、情事變更及解釋空間八類缺失，易導致疑爭議與糾紛，亟待檢討改善。有鑑於此，本研究乃彙整實際案例，針對工程設計文件瑕疵的態樣探討，最後藉由案例解析其爭點，並參酌國內之工程契約範本，整理相關請求權基礎供實務運作之參考，俾利提昇工程設計文件品質。 Abstract In construction industry, disputes on construction occur very often. Construction designs and working drawings, for example, are imperfect. Likewise, contracts governing both sides are not fair. The progress of construction and its quality are even influenced. How to prevent the design defects from happening again, therefore, becomes a must lesson to study. By collecting relevant data, this study intends to explore the contents of design drawings and a designer’s obligations and responsibilities in law as well. Besides, drawing defects at the present situations will be further analyzed through relevant investigations and disputed cases. This study tries to find out what causes the drawing defects from a designer’s angle. So far, some defects have been still existed in Taiwan. First, drawings are wrongly designed, missed, and incomplete. In addition, quantity map are missed out. What’s more, drawings do not go well with another drawing and caption. Finally, there might be something wrong with change order and explanations. All of these easily lead to arguments and need improving. In order to promote qualities of design drawings, this study based on real cases focuses on design drawing defects. With issue points and contract samples, it will also examine relevant petitions for practices.
