營建署為工程專業機關，代辦國防部、教育部、經濟部等非工程專業機關之公共工程採購，須負擔「政治」、「行政」及「法律」責任與機關聲譽，同時並負起工程契約執行成敗責任，並充分運用工程專業技能，使獲得一質優公共工程成品，以提昇為民服務效益。 本研究探討營建署代辦公共工程採購過程中，雙方相關權責及責任與代辦協議書中有關工程責任的問題。並以代辦國防部軍眷村改建工程為例，經檢討執行時所遭遇問題及提出解決對策。進而研擬未來代辦公共工程採購時，最佳執行策略及關於工程責任之實用、可行條款，期提昇公共工程採購效益。 The Construction and Planning Agency acts as a professional engineering organization and is commissioned to handle the construction procurement of those non construction specialized organizations such as Ministry of National Defense, Ministry of Education and Ministry of Economic Affairs. The Agency’s mission is to take responsibilities in terms of “politics”, “administration”, “legality”, and “honour”. Furthermore, the Construction and Planning Agency should complete the construction according to the contract and achieve excellent quality for the public. This is a study of the relation between two organizations and the responsibilities proclaimed in their agreement in the process of construction procurement commissioned by Construction and Planning Agency. A case study on military housing redevelopment for Ministry of National Defense was performed. The issues and the alternatives of this case are reviewed to achieve better implementing strategies and workable agreement items for improving construction procurement efficiency.
