    Abstract: 台灣房市景氣從92年SARS風暴以來逐步走揚,去年全國3大都會區推案量達1. 2兆元,是近10年來的推案最高點,其中北台灣(包含基隆、北縣市、桃園與新竹)的推案量9,221億元、台中地區推案量1,755億元、高雄地區的推案量1,051億元。因為市場熱絡,各大建商無不卯足全力推案,但交易越熱絡,所衍生的糾紛也越多,尤其以預售案交易方式最容易產生購屋糾紛。 建設公司的好壞,是建築物品質有無保證的一大關鍵。一般購屋者最關心的不外是區位、價格和品質,然而房屋的品質確實較難掌握,尤其是購買預售屋,在房屋還沒興建之前便要決定是否購買,對於建商施工品質根本無從判斷,這其中存在著相當的風險;因此購屋者須謹慎選擇足以信賴的建設公司,為減少購屋糾紛降低風險的第一步。 民間建案若能有一套施工品質監督機制,再加以有客觀的第三者對施工品質做保證,形成類似公共工程三級品管之監造制度,則更能增加購屋者的信心,施工品質也更有保障。建築物生產履歷目前在國內尚屬於新課題,本研究試著舉出一套新建房屋施工品質確保方式,有別於現行國內一般工程品質認證系統,以利於消費者能從此制度中獲得建物生產者提供的正確資訊,從而降低購買風險,消弭消費者對於建造商的不信任與對建築物的不安全感,藉以減低消費糾紛,使消費者權益可以充分獲得保障。 Taiwan house market prosperous is raising progressively since SARS storm in 1992, the most big district of city in the whole country, the total amount up to 1200 billion at last year, which is a pushing away case peak in the past 10 years, The pushing away case of north Taiwan that (include KeeLung , Taipei counties and cities , TauYung and HsinChu ) measures 922 billion , 105 billion of pushing away case quantity in TaiZhong, 176 billion of pushing away case quantity in KaohShung. Because the warm of market, each Branches will push hard, but the twine that the trade is the hotter, the more disputes derived are, especially most prone to the dispute of purchasing house by way of advance sale case trade. The quality assurance building is whether the quality of construction companies. General buyers are most concerned about is none other than the location, price and quality. But the quality of housing is more difficult to grasp, especially the purchase of pre-sale housing, before the construction of the housing that they have to decide whether to buy. The build quality is no way to Judge on construction. There are considerable risks on it and the first step is buyers have to choose carefully to the trust building companies to reduce the risk of lower housing disputes. Build the construction quality supervision mechanism with the objective to have a third party to ensure the construction quality is also similar to the three-tier quality control of public works supervision system, the better to increase the confidence of homebuyers, the more construction Quality. Buildings in the current curriculum vitae of the domestic production is still a new topic, this study tried to give a new way to ensure the quality of housing construction, different from existing the quality authentication system generally works in Taiwan, consumers can reduce the risk of purchase, consumers eliminate the construction of buildings of no confidence and the sense of insecurity from the system in the building of producers To provide the correct information and this can reduce consumer disputes, so that the interests of consumers can be fully protected
