    Abstract: 主辦機關因承包商延誤履約之對策及探討 中文摘要 根據經濟部最新統計顯示,民國九十四年十二月底營造業登記現有家數為九萬零九百二十六家至民國九十七年十月底登記現有家數為八萬二千六百三十家,約三年的時間解散撤銷及廢止公司登記的家數高達八千二百九十六家為9.12%之負成長,這是相當大之衝擊。因營造業最近幾年來遭受前所未有之景氣蕭條,廠商發生跳票倒閉之情事時有所聞,許多工程主辦機關皆有面臨工程進行中廠商因財務危機、履約管理不善而無法繼續履行契約之經驗,若工程已接近完工階段,如何使工程在可控制之範圍內早日完工使用將是工程主辦機關最大挑戰。 為使履約管理工作能如期如質達成,本研究將公共工程履約過程各種風險因子及機關因應對策加以研擬,以供工程主辦機關參考,使主辦機關對施工廠商延誤履約之風險及因應對策,提供更佳的判斷作為參考。 The Discussion on Government Agency's Strategies against Contractor's Delay in Performance Abstract According to the latest statistics of Ministry of Economic Affairs, the number of registered construction companies was 90,926 at the end of December 2005, and 82,630 at the end of October 2008. In about three years, the number of revoked and terminated companies had been up to 8,296, equaling to 9.12 percent of negative growth, which was a very large impact. In recent years, due to the fact that the construction industry has suffered from unprecedented economic recession, the phenomenon of check-bounced and close-down of companies is commonly seen. Many host institutions have had the experiences of facing the contractors’ being unable to carry out the contract, either due to companies’financial crisis or poor performance management. If the construction project is near the completion stage, the biggest challenge for host institutions will be how to, within controllable range, make the project finished as soon as possible. For the purpose of making the work of performance management well done—not only in time but also with quality, this study will survey various risk factors of the implementation of public works, as well as devise strategies that host institutions could adopt in the face of these risk factors. The study, hopefully, will be a useful reference, providing host institutions better judgments on contractors’ delay in performance.
