Abstract:	本文探討生物資料庫之保密倫理，針對生物資料庫研究目的和設計所特有的保密問題進行分析，以規劃出周全的生物資料庫保密機制，維護參加者的保密。考量基因資訊是持久的家族性資訊，基因資訊一旦被洩漏，參加者及其家人乃至於族群與後代子孫，將承受來自被社會各界歧視的不公平待遇，甚至目前知識還不能設想相關人等將面臨多大的風險。因此，本文以康德義務論、功利主義和儒家倫理學等觀點進行分析，以尊重自律原則證成生物資料庫對參加者具有保密義務。並且以不傷害原則來證成生物資料庫的保密，應用傳統醫病關係中的保密原則證成生物資料庫保密，考慮當保密原則與公共安全相衝突的情況，以醫護人員具有維護公共安全的積極責任，在規劃完善的保密機制前提下，支持建置生物資料庫以維護公重安全的合理性。參考各國生物資料庫的保密機制，提出符合生物資料庫功能運作，可追溯參加者身分的匿名化保密措施，並且配合相關的保密措施，包括研究計畫必須經過倫理委員會的審查許可、資訊系統的保密管理、鼓勵家庭式同意、限制使用對象、防災應變措施和解體時的資料處理等，以健全生物資料庫的保密機制，實踐對參加者的保密義務，維護參加者的隱私權利。 This thesis is an investigation of the ethical problem of confidentiality of Biobank. In order to design a confidential system of biobank to protect the participants, the focuses on the analysis of the purpose of biobank and its confidentiality. With gene information being familial information, once it leaks out, the participants, their families and their descendants will by the public, risks beyond our imagination.This thesis use the principles of nonmaleficence and the confidentiality of Professional-Patient relationship support the confidentiality of biobank. When there is a conflict between the principle of confidentiality and public safety.
