本論文主要是在探討男性愛滋病患以及女性愛滋病患的病情資訊在不同的情境狀況之下公開與否的問題。尤其是在何大一發明了雞尾酒療法以後，愛滋病就慢慢的以原本的法定急性傳染病的狀態慢慢轉變為常期慢性病的狀況，這兩者之間有著什麼樣的不同？醫生在面臨到這樣的狀況時，對愛滋病患資訊的公開程度應該做出何種程度的考量？病人的隱私權到哪種程度？這些都是本論文欲深入進行探討的問題。 兼則，愛滋病是一種受他人歧視的疾病，跟其他的疾病比較起來，更容易受到他人的誤解以及厭惡。所以，愛滋病跟其他疾病相較起來，病情資訊公開與否，相形之下，就顯得更加的困難與重要了。因為，病情資訊的公開與否，衝擊到的，將會是病人的工作、家庭、生活以及其他相關的社會連結。 在雞尾酒療法以及受他人歧視，這兩種因素的影響之下，醫護人員應該要對愛滋病患的病情資訊做出何種程度的公開？已經是現下的生命倫理課題中，勢不可免，我們必定得要解決的問題，以期能夠達到愛滋防治以及愛滋病患良好照護的目的。 我將在本論文展示出，當醫療人員面對不同的愛滋病患時，是否應該要持守愛滋病患的隱私權，違反保密義務，以達到避免無辜的第三者受到傷害的目的。經由本文進一步的分析指出，無論醫療人員面對何種病患，醫生都有違反保密的義務，避免其他可能的第三者受到愛滋病患的傷害。 The aim of the essay is discuss AIDS patients’ medical record could be disclosed or not. Especially, after David Ho creating the cocktail therapy, the character of AIDS disease is totally changed. The status of AIDS has been changed from acute infectious disease to long term disease. What is the difference from acute infectious disease to long term disease? When the medical face to the situation, how should they deal with the AIDS patients’ medical record? How about the patients’ privacy? Moreover, The AIDS is a disease which was discriminated. The AIDS disease is more easily been understood and haten from others. Therefore, compare to other disease, disclose the AIDS patients’ medical record or not is more important and difficult. Because disclose the AIDS patients’ medical record or not might impact the AIDS patients’ occupation, family, daily life and other social connection. Under the effect of cocktail therapy and being discriminated from others, what the medical should take which degrees of disclosure？It has been the issue which we have to handle immediately. By doing this, we could achieve the purpose of AIDS prevention and well medical care of AIDS patients. In this essay, I will argue that no matter what kind of circumstances the medical face to, the medical should to breach confidentiality to keep the innocent third party from harm.
