摘要: | 我國為了解決行政機關處理國家任務的龐大事務,並解決行政機關常受限於法令規章及層級節制之束縛,造成行政運作上無效率及欠缺彈性,在行政院組織改造的計畫推行下,透過民營化、委外辦理及法人化等方式,其中之法人化,即包括了設立行政法人此一組織型態。 行政法人設立的目的在於負責處理政府及民間皆不適合的公共任務,例如:文化藝術、教育、研究等公共任務;由具有獨立性、講求效率與彈性化組織型態,並具有公法人定位的-行政法人來執行這類公共任務。 國立中正文化中心為我國唯一的行政法人機關,中正文化中心的主要任務在於推廣表演藝術的發展,並作為國家性規模的文化發展中心。在中正文化中心改制為行政法人後,發生了不少爭議,本文針對其決策制度的爭議,即董事會、董事長與藝術總監制的爭議,透過法律制度面、組織面、權責關係,及首長詮釋與作為等角度切入探討;本文提出研究建議包括:1. 董事會及藝術總監皆應透過董監事人才庫的方式公開徵選。2. 行政法人法應修法增列雙首長制,以避免與個別組織法混淆。3. 法規增列藝術總監辭職時,由董事會成員選出暫代,避免董事長兼任二職。4. 為避免無給職董事長與藝術總監爭權,需另設立誘因機制。In order to solve the administrative authorities deal with the huge affairs of the state task in our country, and to resolve the shackles of the executive authorities normally limited by the laws and regulations and hierarchy resulting in inefficiency and the inflexibility in the administrative corporation of the implementation of the Organizational Reform of the Executive Yuan,through private , outsourcing activities and corporatization,in which the corporatization, including the establishment of the Administrative Corporation organization form. Administrative corporation established for the purpose isto handle the public tasks of the government and private sector neither suitable, such as: arts and culture, education, research and public tasks; by independence, emphasis on efficiency and flexible type of organization, and with public and corporate positioning–Administrative corporation to perform such public tasks. The National Chiang Kai-shek Cultural Center is the only administrative corporation authorities, the main task of the Chiang Kai-shek Cultural Center is to promote the development of the performing arts, and as a national scale Cultural Development Center. Chiang Kai-shek Cultur- al Center transformed into administrative corporati-on, had a lot of controversy, the controversy for its decision-making Institutional, the Board , Chairman and Artistic Director of the Institutional of dispute through the legal aspect of the Institutional, rganization , powers and responsibilities of the relationship, and the directorate interpretation, and as the viewpoint to explore; This paper presents the study recommendations include: 1. Board and the Artistic Director of both should be through the talent pool of directors and supervisors of the way openly for selection. 2. Administrative Corporation Law amending the law added to the dual leadership Institutional, to avoid confusion with the individual organizations Law. 3. regulations added to the resignation of artistic director, elected by the members of the Board to temporarily avoid the chairman to serve as the two jobs. 4. in order to avoid the power struggle of no remuneration of the chairman and artistic director, subject to set up an incentive mechanism. |
