iPS 細胞相關研究在國際間方興未艾,然台灣行政部門迄今仍未就iPS 研究相關法律與管制議題有所回應,學術界對此也未有較深入的探討。本研究計畫企圖填補此項漏洞。探討我國應採用什麼樣的管制架構,才能使iPS 相關研究邁向實用化。並從管制政策、管制工具與管制制度三方面著手,分析國際治理架構,確認我國現行管制架構的缺失,然後提出建言。本研究計畫將出版專書總結研究結果。這本書將分成九章。第一章將首先說明iPS 細胞相關研究的科學背景以及其對法律和管制議題的意涵。第二章將彰顯如何運用管制治理的方法運用到這個參考領域。第三章將從其他國家的管制經驗,特別是日本得到一些啟發。第四章將分析可能的國際治理之影響。第五章將評估涉及使用iPS 細胞的發明專利對研究和治療的意涵。第六章將澄清iPS 細胞相關研究的管制目標,特別是製造和使用由iPS 細胞獲得的配子。第七章將凸顯在管制這個領域時,管制工具的可能混合模式和最佳的混合模式。第八章將強調制度改革,特別是高層次生命倫理委員會的設置和專業幹細胞研究倫理委員會的建立。最後一章將提出簡要的結論和建議。 ; iPS cells related research expands internationally at an unprecedented pace. However, neither the competent authorities nor the legal circles in Taiwan have deliberately responded to this new development. This project attempts to close this loophole. Taking a regulatory governance approach, this project will explore what kind of regulatory framework should be adopted in Taiwan to bring iPS related research into practical use. This project will make reform recommendations, after analyzing international governance and diagnosing deficiencies of the existing regulatory framework from the perspectives of regulatory policies, regulatory tools and regulatory institutions, This project aims at publishing a book to present the research results. This book would be divided into nine chapters. Chapter one will explain the scientific background of iPS cells related research and its implications for legal and regulatory issues. Chapter two will highlight how the regulatory governance approach will be applied in this reference area. Chapter three will get some inspirations from regulatory experiences in other countries, especially Japan. Chapter four will analyze the influence of possible international governance. Chapter five will evaluate the implications of patent involving inventions using iPS cells for the research and therapy. Chapter six will clarify the regulatory objectives of iPS cells related research, especially the issue of producing and using iPS derived gametes. Chapter seven will show the possible mixes of instruments and the right mix for regulating this area. Chapter eight will underscore institutional reforms, in particular the importance of a high level bioethics commission and specialized ethics committees for stem cell research.
