現行國內公共工程屬公有建築物新(興)建工程案的執行作業程序,自委託專 業廠商負責規劃設計、監造、招標、施工等階段的作業程序均依政府採購法及相 關法規規定辦理。但在履約階段若是設計人兼任同案監造人,易因設計疏失或暇 疵等情事,為掩飾責任而對其做出有利解釋,肇生工程爭議端倪,甚有須以調處 程序解決。本研究以查核金額以上建築標案為範疇,利用行政院公共工程委員會 「常用資訊系統」網頁(99-104年)、內政部工程施工查核小組網頁(99-103年)及 教育部工程施工查核小組網頁(99-103年)等公開網路資源進行在建標案及查核案 件蒐集,並利用相關文獻及專案訪談等研究程序,建立問卷題目子項,透過問卷 回收彙整出研究結論及建議,以提供各工程主辦機關及相關設計單位之參考。 ;The current execution and operational procedure for new public building construction projects includes planning, design, tendering, construction and, supervision, and the procedure is performed by conforming to the Government Procurement Act and other relevant laws and regulations. One common practice is that a party simultaneously serves as the designer and supervisor of a public construction project. However, such a practice may have problems that the party makes concessions for itself by forgiving its own design mistakes and defects that are found during supervision, resulting in construction disputes between the party and a project owner or a main contractor and requiring mediation to solve the disputes. Therefore, this study has two objectives: discovering whether the abovementioned practice affects construction quality and identifying significant problems that result from the practice. This study focuses on the public building construction projects with contract amounts over 50 million and uses construction surveillance data collected from web pages of the Public Construction Commission (data from 2010 to 2015), the Ministry of the Interior (data from 2010 to 2014), and the Ministry of the Education (data from 2010 to 2014) for analysis. This study also interviews experienced domain experts to determine questions for questionnaire surveys for practitioners. This study finds that no significant evidence can prove that the practice affects construction quality and also identifies multiple critical problems for the practice. Suggestions are finally given based on the results of data analysis and questionnaire survey.
