食品安全於人類乃為重要事項,當食品類型越來越多元化之際,需由一個更強大的監管來控制食品發展的不確定性,以確保民眾食的安全。本文從風險出現為由開始討論,於食品衛生安全範圍中肯認風險出現,因此行政機關以風險評估為立基,符合滿足國民享有之健康、安全食品以及知的權利、事先預防原則、資訊透明等等,以資訊行為作為一種行政管制。 然則對於提供食品資訊之行為乃為行政機關、業者、人民三者關係。故行政機關提供食品而致人民權利受到侵害,不論業者或消費者,在適用於國家賠償法第2 條第2 項時,都將可能面臨許多問題,而關於國家賠償法要件的認定於學說與實務上尚未有完整一致的方向,對於國家賠償法的制度與要件討論將為本文重點。;Food safety is important in human matters .it shall establish a food sanitation and safety monitoring system to controll the uncertainty of food to ensure people ′s food security.This article began to discuss the risks and recognize the risk of food safety and hygiene. Therefore, the actions taken by the competent authority in the governing of food safety shall base on risk assessment and shall align with satisfying the citizens’right to have healthy and safe food and the right to know, as well as the principles of precaution, and information transparency. It is a administrative regulation which administrative agency provides information of food products. Providing information of food products include tripartite relationship; government、food businesses and consumers. When administrative agency provids information of food products, the rights of people might be infringed, no matter they are food businesses or consumers. It’s hard to apply to Article 2-2 of the state Compensation Law, because jurisprudent theory and our judicial opinions have not yet complete and consistent direction for the system. So the main purpose of this study is focus on how to apply to the state compensation law.
