近年來動物倫理成為應用倫理研究中的顯學，特別是動物權利理論漸受矚目。然而動物權利是一個什麼樣的主張，動物權利將如何改變人類社會實踐？釐清相關概念在動保議題日漸公共化的今日實具有急迫性。動物權利的研究促使我們認真且嚴肅地思考人類所珍視的權利概念適用的對象，探問為何要將權利理念拓展到動物身上？同時我們也要務實地找出可供實踐的動物權利理論架構，反思是否可能讓我們的社會在追求自由多元價值的過程中，既建構出恰當的動物對待方式又能維持良好的社會生活模式。本計畫將藉由文獻分析方法，整理並分析西方眾多具代表性之動物倫理文獻資料，包括耙梳被分類為動物解放、動物權利及動物正義等諸多分歧觀點，再從近期的學術討論中檢視先前的爭議所在，最後再嘗試以人類義務與動物權利的相互關聯性找出較為合理可行的動物權利理論。本計畫擬以兩年為期，第一年的研究焦點集中於從權利理論探討動物權利概念，包括動物能否擁有權利？動物權利如何可能？哪些動物擁有權利？擁有哪些權利？動物權利的範圍如何界定？動物的權利與人類權利是否相同？第二年的研究焦點集中於探討人類社會中合理的動物權利規範，畢竟人類利益和動物利益之間終究會有一些真正的衝突，如何恰當安排人與動物的權利關係，在保障動物利益的同時也讓人類社會生活得以維持，正是動物倫理不可迴避的重要任務。 ;In recent years, animal ethics has become important issue in applied ethics research, especially when the academic community pay much attention to the theory of animal rights. But what kind of claim is animal rights, and how will animal rights change our social practices? It is urgent to clarify the related concepts of animal protection issues in the publicity of today’s changing attitudes to the animal rights. The study of animal rights makes us to think sincerely and seriously about what concept of rights that we appreciated can be applied to, and ask why we should extend to animals? At the same time, we must also pragmatically find out the theoretical framework of animal rights that can be put into practice, and reflect on whether it is possible for our society to construct appropriate animal treatments and maintain a good life in the process of pursuing liberal and pluralistic values.This project will use literature review method to examine and analyze representative animal ethics researches, including sort out the divergent views classified as animal liberation, animal rights, and animal justice, and then review the controversies arisen from the recent discussions among animal ethicists. Finally try to find a more reasonable and feasible theory of animal rights based on the correlativity of rights and obligations.The project is intended to be a two-year period. The first year's research focuses on exploring the concept of animal rights from the theory of rights. Main questions would be as follows: Whether animals have rights? How is animal rights possible? Which animals have rights? What kind of rights do they have? What is the scale of animal rights to be defined? Are animal rights exactly the same as human rights? The second year's research emphasizes on the research of reasonable animal rights norms in human society. After all, there will be some conflicts of interest between human and animal. It is also an inevitable mission for animal interests to be protected, while the human social life to be maintained at the same time.
