本研究探討「司法院釋字第748號解釋施行法」的施行,對客家宗族社會造成的多層面衝擊,以及宗族/親所採取的因應方法,作為後續推動客家祭儀發展性別友善的參酌。宗族與宗親交織而成的社會發展型態,是客家在地社會的重要特性。宗族的延續與擴展,乃基於同一父系血親男性,通過異性戀婚家體制組成的超家庭系統,力盡生育子孫與傳宗接代的責任,達到世系綿延不斷。宗族社會具有嚴謹的性別規範與秩序,獨尊異性戀婚姻。因而,2019年748施行法的正式施行,以父系繼嗣為核心的客家宗族社會面臨多面向挑戰。本計畫研究主題主探討客家宗族社會對同志婚姻法的省思,了解法律施行兩年後至今的衝擊為何,蒐集宗族的因應措施。主要研究目的有兩個:一、蒐集分析748施行法對客家宗族社會的衝擊層面,以及其所採取的因應作法;二、探討客家宗族男子氣概、性別配置與秩序的變化,進而提出推動同志入祖塔(家塚)的可能策略與方法。本計畫以兩年工作期程,蒐集分析客家宗族社會如何因應同志婚姻的社會事實,理解客家在地社會的視角,進一步探討性少數群體在客家宗族社會的婚姻權益,最後提出推動宗族發展多元性別友善的策略與方案。同時,本研究也將進而提出適當概念與解釋,並發表相關研究成果。 ;This study explores the multilevel effects of the Act for Implementation of J.Y. Interpretation No. 748 (hereinafter referred to as the Act) on Hakka lineage (zhong zh?) and society. The coping methods adopted by Hakka lineage can be used as references for subsequent promotion of Hakka rituals in developing gender-friendliness. The interwoven social development pattern of lineage is a crucial characteristic of Hakka local society. To extend and expand the lineage, men of the same patrilineal clan engage in heterosexual marriages. Specifically, the male descendants must fulfill their responsibility of having offspring and sustaining the patrilineality to conform to the Hakka family system. The lineage society has strict sexual norms and orders, which upholds heterosexual marriage as the sole marriage system. Therefore, in 2019, the implementation of the Act posed multilevel challenges on Hakka lineage societies centering on patrilineal descents. This study focuses on exploring the reflection of Hakka lineage societies on same-sex marriage and understanding the impact on Hakka lineage after the Act was enforced 2 years ago, as well as determining the Hakka lineage coping measures. The main objectives of this study are as follows: a) collect the impact of the implementation of the Act on Hakka lineage and their coping measures, and b) explore the Hakka lineage masculinity, sexual norm order changes, and possible strategies and methods to promote LGBT group to be enlisted in the ancestral pagoda (family tomb). This research project will be conducted for 2 years to collect data and analyze how Hakka lineage societies respond to the social truth of same-sex marriage, understand the Hakka local society perspective, and further explore the marriage rights of sexual minority in Hakka lineage societies. Then, strategies and programs for developing gender diversity and friendliness in Hakka lineage societies will be proposed. The present study will also propose suitable concepts and explanations and present relevant research outcomes.
