    Abstract: 在房地產交易中存在許多糾紛。最嚴重和最頻繁的糾紛是由於漏水問題產生,每年因漏水爭議導致數百起的訴訟。
    本研究的目的是建立評估模型,透過評估模型來評估因漏水導致受損的建築物或建築之一部分。本研究由文獻回顧作為本研究開端,藉由回顧專書、期刊與論文中有關資產價值減損、爭議解決、及影響屬性之整體理論及應用,藉由前述相關文獻彙整出專家訪談之問題。專家選定之資格為8年以上工作經驗和從事實務技術人員、律師和學者等職業,其中6名專家具備漏水鑑定相關證照,以蒐集因漏水造成建築物價值減損之理論發展等相關專業知識。
    最後藉由個案研究,以漏水鑑定實際案例比對專家訪談結果應用於訴訟案件中,詳細說明如何進行實務上之評估。對解決漏水所引起之訴訟實踐,具有重要意義。;There exist numerous disputes during real estate trades. The most serious and frequent dispute is due to water leaking problems resulting in hundreds of lawsuits every year. The study purpose is to establish the appraising model to estimate those damaged buildings or parts of building by water leaking. The study started with a comprehensive literature review that provides an overall theories and applications in asset value deduction, dispute resolution, and influence attributes. It also summarized questions for the expert interviews. With the setting for expert qualification to work experience greater than 8 years and occupations in practical technicians, lawyers, and scholars, six experts were qualified and interviewed to gather expertise for the theory development of appraising value on damaged buildings caused by water leaking. The theory was then applied to the empirical lawsuit cases explicitly in details for how the appraise may be implemented. The contribution is significant to the practice in resolving the litigation caused by the water leaking.
