當承包商提出展延工期索賠時，大多數情況下，業主不會同意承包商的索賠金額，導致承包商和業主之間發生爭議。不同原因引起的展延工期，其補償費用的內容會有所不同，部分的費用可以列入補償範圍，部分則無法列入補償範圍，必須針對問題通過具體分析來決定。而實務上，承包商大多為不熟悉工程索賠的程序和方法，缺乏索賠必須的有關資料、數據和記錄等。本研究採歸納分析方式，收集國內外工期遲延或展延工期相關研究報告及重要文獻，比較國內各機關契約範本中的計算公式，及國外能夠收集到的計算方式。此外，透過案例分析，針對影響展延工期因素、展延補償處理依據、管理費補償計算方式及所得到之補償金額比率進行試算分析，整理出工期展延相關之爭議事件時索賠金額計算作為參考，進而提出「時間關聯成本求償方法之選用流程圖」，透過此一流程圖，承包商執行工期展延與相關費用請求時，可以參考該流程圖，逐一檢視本身工作的完整性，以及該如何選擇最合適時間關聯費用的計算方式，以利獲得對本身最有利的求償結果。;In most cases, a contractor claims on Extension of Time (EOT), but the owner won’t agree with the compensation the contractor claimed. That’s why disputes usually occur between contractors and owners. There will be different costs caused by different EOT situations. Some of them can get paid, and some don’t, depending on the outcomes of comprehensive analyses for each situation. In practice, because of the lack of understanding on claim procedure and time-related costs calculation approaches, contractors usually fail on necessary collection of data, evidence and records for successful claims. Based on an intensive literature review, this study then adopted an inductive analysis to collect available time-related costs calculation approaches for EOT. Furthermore, this study performed time-related costs calculations for two real cases based on collected delay factors, compensation regulations in contracts, and other evidence. This study has developed a selection procedure of time-related costs calculation approaches for EOT. The contractor can use the procedure to check the completeness of claim preparation and how to select suitable time-related costs calculation approach for best claim outcomes.
