促進民間參與公共建設法(以下簡稱促參法)作為我國推動民間參與公共建 設之法規範,不僅規範民間參與公共建設之辦理方式與程序,亦針對主辦機關與 促參案申請人之權利與義務定有明文,然而在實際運作上仍產生諸多問題。首先, 本文採取修正式雙階架構,將民間參與程序區分最優申請人之甄審程序以及締結 促參投資契約兩階段程序,甄審決定與投資契約定性為公法性質,人民欲就促參 爭議提起救濟時,即應循公法上之救濟途徑為之,以避免發生公法、私法上銜接 困難,以及法院裁判各異之問題;其次,本於基本權保障之意旨,人民作為促參 案之申請人,除享有正當行政程序之保障,國家亦須保障其享有公平自由之競爭 地位,並建構權利受侵害時之救濟機制。最後,最優申請人除享有申請人地位與 權利之保障外,在甄審決定作成後,作為取得與主辦機關議約、簽約資格之人, 若此法律地位或相關權利受有侵害時,即享有排除侵害、請求賠償或補償之救濟, 同時亦得透過訴訟參加制度以維護自身權益。;This thesis examines the Act for Promotion of Private Participation in Infrastructure Projects (referred to as the "Act") as a regulatory framework in Taiwan for facilitating private involvement in public construction. While the Act outlines the procedures and processes for private participation and specifies the rights and obligations of both sponsoring authorities and applicants, numerous operational challenges persist.
To address these issues, a modified two-stage framework is proposed in this study, which subdivides the procedure of private participation into two parts: the process for evaluating the best applicants and the process for concluding investment contracts under the Act. It emphasizes that evaluation decisions and investment contracts possess a public law nature, warranting the use of public law remedies to settle disputes. This approach aims to mitigate difficulties in reconciling public and private law and ensure consistency in court judgments.
Moreover, recognizing the significance of safeguarding fundamental rights, this research emphasizes that applicants under the Act should benefit from not only the protection of legitimate administrative procedures but also the guarantee of fair competition and the establishment of mechanisms for remedies in case of rights infringement. These measures are essential to maintain a balanced playing field and uphold the principles of justice and equity.
Lastly, the study asserts that the best applicants, once the evaluation decision is issued, hold a privileged position as individuals qualified to negotiate and sign contracts with sponsoring authorities. In the event of any infringement upon their legal status or associated rights, they are entitled to seek remedies, such as exclusion of infringement,compensation, or redress. Additionally, the thesis suggests that they can actively engage in litigation procedures to safeguard their rights and interests.
