頂樓違章建築幾乎是全臺灣共有的現象。本文以臺北市頂樓違章建築為研究範疇,藉由問卷調查來了解民眾對頂樓違章建築處理的看法,並配合現行法令規章探討,期能提供政府主管機關處理頂樓違建之參考依據,從而解決或降低公共安全問題,並可兼顧民眾利益。 針對374份頂樓違章建築問卷調查前六大結果包含:(1)妨礙其他同棟住戶使用屋頂平台的權利(2)影響避難逃生(3)影響建築物整體結構安全(4)影響整體市容觀瞻(5)合法平屋頂改斜屋頂高度限制不合使用及安全性之問題(6)期待市府能提出一套更有效的管理制度,以符合公眾利益。 綜合調查結果及法令規章探討,其建議有下列四點:(1)建立既有頂樓違建報備制度,以利列管並防止違建有再擴大情形發生。(2)針對設有直通樓梯通往屋頂平台之頂樓違建,皆應於面對道路或基地內通路處留設無頂蓋式之避難逃生空間。(3)84年以後產生之新頂樓違建,仍應強制執行拆除頂棚棚架下方圍束之室內使用空間,再取得相關證明文件後,方可留設頂棚棚架。(4)對於合法建築物平屋頂建造斜屋頂之高度限制問題,應視是否設有直通樓梯通往屋頂平台酌予放寬高度限制。 Roof Annex is a common illegal construction problem in Taiwan. This research is base on roof annex of Taipei, in order to investigate what citizen think about roof annex by using questionnaire, and cooperating with the rule discussion. We are wondering if this research can provide a comment to government to handle roof annex. It might be solved or reduced the public safety problem, and profit citizen a lot. Base upon 374 questionnaires investigation of roof annex, the top six as: (1) Hinder other rights of using platform on the roof (2) Influence neighborhood to take refuge (3) Influence the safety of the building structure (4) Influence the whole appearance of the city (5) The problem of insufficient height and safety of oblique roof which changed from legal flat roof building (6) Expect the government can provide more effective management systems, in order to accord with public profit. Comprehensive investigation result and rule discussion, four comments as below: (1) Setting up the building which already has roof annex, to manage and prevent disobeying and expanding the situation (2) The roof annex without direct stair to roof, must be provide space for refuge (3) The new roof annex after 1995 can be kept after they got official license, but construction under roof must be removed (4) The height restriction question on the oblique roof building, extension of height of roof will depend upon whether a stair direct to the roof or not.
