| 摘要: | 兩岸原為同文同種之民族，無奈因國共內戰導致海峽兩岸分離至今，隨著兩岸間的經濟、文化、學術等交流日益頻繁，兩岸間的婚姻制度更加彰顯其重要性。本文的內容參考了國內外著名學者的巨作及各大院校的碩博士論文，融會貫通後將其內容作一完整的鋪陳，並提出筆者的淺見。 研究中發現不論我國或大陸，其婚姻制度都有其優缺，就整體而言我國的婚姻制度優於大陸的婚姻制度，我國的婚姻制度因一脈相傳深厚的理論基礎外加與我國的風俗民情較能切合，雖仍有不盡理想之處，但歷經1980年代後多次的修改已經趨於完善，但仍有不足之處，這正是本文研究之所在。而大陸的婚姻制度因深受馬克思主義的影響而與我國的婚姻制度截然不同，就正因缺乏理論的脈絡性，所以其立論基礎較為薄弱，相對的其科學性與完整性與我國相較，自然不如我國，但某些部分卻可為我國所借鏡，這是不可諱言的。 希望藉著本文能找出兩岸婚姻制度之異同，並見賢思齊見不賢而改之，筆者的淺見盼能對未來的修改之路略盡棉薄之力，使我國的婚姻制度更加完善。 Two sides are originally and gentle and the same kind of nationality, helpless because Kuomintang and the Communist Party's civil war causes both sides of the Straits to separate so far, as economy , culture , academy between two sides ,etc. are exchanged day by day frequently, the marriage system between two sides reflects their importance further. The content of this text has consulted great work and the large theses for the Doctorate of every large universities and colleges which are called the scholar both at home and abroad, do a intact elaborating of its content after gaining thorough understanding through comprehensive study of the subject, and propose the author's superficial view. Find no matter our country or the continent while studying, it is excellent and scarce that their marriage systems both have it, the marriage system of our country is superior to the marriage system of the continent as regards whole, marriage system of our country because one pulse deep theoretical foundation and custom condition of the people in our country can relatively suit according to legend, although there are places not ideal, a lot of modification has already become more and more perfect after going through 1980 times, but there are weak points, this is that this text studies . And the marriage system of the continent is completely different from marriage system of our country because affected by Marxism deeply, because lacking the train of thought of the theory, the foundation is comparatively weak that it sets forth one's views , as to its science and the integrality and of our country looks, relatively, naturally it last our country, but some parts can be drawn lessons from by our country, this can not dare not or would not speak up. Hope to make use of this text and find out the similarities and differences of systems of two sides' marriage , and see that thinks and can not see virtuously and change it virtuously together, slightly try the thin strength of cotton best on the way where my superficial view can look forward to modification of the future, make the marriage system of our country more perfect. |
