擬定監造不實認定流程，釐清因法規或契約規定不明備而產生的矛盾與爭議，作為主辦機關辦理監造不實的依據，建議將監造不實認定流程增訂為採購法63條第2項之施行細則，提出監造相關法律之修改建議，監造契約亦應增訂監造不實認定流程。主要透過訪談監造主管機關及主辦機關以了解現在實務上監造不實認定的原則、方法與流程，進而建立一套監造不實認定程序，期望能影響監造實務而獲致實用，以符合採購法第63條第2項之立意。 In contracting for the services of planning, design, supervision, or management, an entity shall stipulate in the contract the responsibility of the supplier in the event that erroneous planning and design, irresponsible supervision, or poor management has caused damages to the entity.
