政府採購法規定,機關工程之定作、財物之買受、定製、承租及勞務之委任或僱傭等皆須透過適當合理的採購程序,但機關與優良廠商合作後,在後續採購中若是期望可繼續合作以擴充契約,即可能造成採購綁標之疑慮,因此政府採購法設立後續擴充制度;若是機關採購於原招標公告及招標文件敘明擴充之期間、金額或數量,並且採購履約品質經機關審核為優良,廠商即可取得優先議價的機會,於新的合約達到原有契約的擴充。 根據行政院公共工程委員會資料統計,政府採購法施行至97年今共有165萬7,643件採購案,其中以限制性招標後續擴充模式進行採購共有1萬4,907件,卻發現無研究對於後續擴充作一探討,不論是後續擴充是否可有效提升採購成效、可提升的成效為何、制度執行上的缺失改善等,皆表示目前未能善用這1萬4千逾件後續擴充案例經驗以檢討制度缺失及評估其成效,造成機關不了解後續擴充制度,未能靈活運用制度優點,提供誘因使採購成效提升。 綜合上述問題,本研究對於後續擴充執行現況進行調查,並篩選已執行後續擴充案例加以分析,彙整後續擴充執行經驗並且分析使用後續擴充後可提升之成效,從中檢討並解決後續擴充推動上的障礙,減少採購人員於使用後續擴充制度將面臨的困難,藉此建構後續擴充採購作業流程,供機關作為教育訓練的教材,讓機關決策者於適當的採購中施行、採購人員於正確的流程中辦理,期能使後續擴充制度產生最大的成效,提升我國採購之效率與品質、節省採購之成本及加速公共建設的推動。 “Procurement Extension” is an innovative model in Government Procurement Law, of which an agency can minimize the effort of public tendering by announcing multi-stage procurement cases at once. Government agencies can save time and budget whenever procurement extension is possible. However, statistics show that most government agencies do not embrace this innovative procurement model. Apparently, the few, who do choose to adopt this model, face the risk of mismanagement and resistance from front-line public servants. According to government statistics, after the promulgation of Government Procurement Law, the total number of procurement cases is 1,657,643, but only 14,907 of them adopt procurement extension. Most disappointingly, no study has ever been done with regard to the lessons learned in promoting procurement extension. This confirms the agencies’ negative view towards this innovation procurement model- the accumulation of experience is stagnant or even non-existent. This work aims at examining real-life procurement extension cases, and tries to extract lessons learned from them. This work conducts interviews and develops case study which contains various field experiences related to the promotion of procurement extension. The outcome of this work may be used as training material upon government agencies and has to potential to facilitate a wider adoption of the procurement extension model.
