    Abstract: 現行勞務採購所使用契約中,多數係以過程為導向之契約型態,亦即藉由過程的履約管理,使其達到業主所預期的成果。目前國外所使用之成效式服務契約(Performance-Based Service Contract, PBSC)有別於傳統技術與過程導向之契約型態,改以產出與成效目標為衡量基準的新型態契約。經本研究分析,國內現行勞務採購契約存有下述兩項問題:(1)現行勞務契約所規範之行為,多數對於專案成效帶來效益值得商榷、(2)無法激勵承攬廠商採取更好的履約方式,提升專案整體成效。本研究藉由文獻回顧、標竿學習及專家訪談等方法,對於勞務採購應用成效式契約進行初步研究。本研究具體成果包括:國內成效式勞務採購契約範本(技術服務契約範本)、工作成效說明範本、成效式契約執行流程、訂約注意事項,及採用成效式勞務採購契約可能存在之問題。期待本研究之成果可做為國內於勞務採購導入成效式契約之基礎,使勞務採購能因為成效式契約的採用而獲得服務成效之提升。;When performing service procurements, most of owners employ process-oriented contracts which imply achieving anticipated outcomes through managing whole project execution processes. Beside Taiwan, many conturies adopted an innovative contract type, the Performance-Based Service Contract (PBSC), which focuses on project outomes and performances rather than processes in traditional contracts. This study found two major problems in service procurements in Taiwan, including (1) most of contract requirements might have no direct link to project performances and (2) no effective approach to incentive contractors to improve project performances. This study employed literature review, benchmarking and expert interviews to investigate the possibility of applying performance-based contracts to service procurements. Essential outcomes of this study include a standard form of PBSC, performance work statements for PBSC, clear execution processes and key issues for implementing PBSC, and possible obstacles of using PBSC. It is anticipated that the outcpmes of this study can be a basis of implementing PBSC in Taiwan which improves the performances of service procurements.
