本研究的目的係以專案管理手法探討各不同履約爭議機制的差異。 在文獻回顧的部分以國際專案管理協會(PMI)所頒布的十大知識領域及 其相關的運用作討論與整理,另蒐集國內行政院公共工程委員會、交通 部高速公路局、各縣市政府的工程採購契約範本以及國際工程契約範本 ---國際諮詢工程師學會(FIDIC)1999 年版紅皮書與英國土木工程師學會 (ICE)的新工程契約範本(NEC),針對不同範本整合其爭議處理程序的異 同作分析比較。研究成果以表列的方式呈現十大知識領域分別在調解、 仲裁、訴訟及爭議裁決的重要性。除此之外,本研究亦以四個實際案例 輔助說明研究內容與成果的關聯。;The study goal lies in the exploration and comparison of dispute resolutions for construction projects using project management concepts. Literature review explore those 10 types of domain knowledge of project management brought by Project Management Institute (PMI) and the connection among those. We also collected domestic contract templates for construction from Public Construction Commission, Highway Construction Bureau, and city/county governments, and international contract templates from FIDIC 1999 version and UK Institution of Civil Engineers. Integrating the most common resolution processes, the study tabulates the importance for those 10 domain knowledge used for mediation, arbitration, litigation, and Dispute Adjudication Board (DAB). Four empirical case studies are discussed to illustrate how the resolution works combining the study findings.
