Abstract:	公務人員彈劾影響其訴訟權與服公職權利甚鉅，自應符合正當法律程序。監察法未區別對人彈劾（及糾舉）與對事糾正，對彈劾正當法律程序規定保障不足。本計畫研究的核心議題如下：學說上如何確立憲法第16條訴訟權保障與第18條服公職權、以及法治國家原則所要求的正當法律程序原則適用於彈劾，現有監察法等相關規定有哪些不符合彈劾正當法律程序，懲戒法院判決對彈劾正當法律程序論理有哪些不足，公政公約第14條及歐洲人權公約第6條對於懲戒公正程序，以及德國聯邦公務員懲戒法對於行政機關懲戒程序規定，對於建構我國彈劾正當法律程序原則有何啟發。
