| dc.description.abstract | 我國著作權法於民國八十一年修法前有關建築、土木等相關著作皆歸類為美術、圖形及文字著作範圍加以保護，著作權相關爭議也並不如其它一般著作來得嚴重。主要原因除了建築、土木等著作僅為少數特定對象及行業工作者才會接觸使用外，其次則因著作權觀念主要源自於西方，在中國傳統社會中，不但類似觀念相當缺乏，甚至有完全相反的習慣存在。
西方人認為，著作人本應對其著作具有完全支配的權利，他人欲利用其著作，或使用其創作，應尊重原創作人，並得到原創作人授權、同意才可使用。因此，抄襲或模仿基本上會被認為是不尊重原創作人之行為。相反的，於中國社會觀念中，雖然認為抄襲是不值得鼓勵的，但是抄襲或模仿行為的存在，往往足以顯示被抄襲者或被模仿者的創作受到肯定，模仿反而是一種尊敬的表現 。
在此種觀念下著作權自然而然不受到我國重視，再加上建築與土木著作其在市場上流通速度、層面與普及度相對不及於其他一般著作，因此所產生的糾紛相對較少。此外，再加上我國政府執法不力及制度上使然，更加重一般民眾對於著作權觀念的忽視，而此種習慣也間接反應在國內工程上。再者，國內契約皆為業主所制訂，因此，業主皆制訂對自己有利的條款…，種種因素造成國內工程中許多不肖業者為降低本身成本、時間而擅自將他人著作直接進行抄襲、模仿或是改作，嚴重侵害及影響原著作人本身的權利。
然而，隨著時代的發展，工程設計者意識抬頭，再加上政府近幾年來加入WTO後，國外政府及廠商挾其政治、經濟等強勢力量，強行將著作權觀念帶入我國，迫使我國不得不再次針對舊法之不足點進行修正。有鑑於此，本文期望藉由此研究促使國內工程界重視工程相關著作權問題，並間接讓工程著作權相關爭議發生率降低，以減少此議題對國內工程界所造成的影響。此外，本研究欲利用類型化分析及趨勢分析，並同時以一個工程人員的角度來剖析法院在面對工程相關著作權侵權爭議時普遍的態度及觀念為何？且由理論及實務觀點分別進行深入的探討，期望最後能找出工程著作著作權爭議（勝訴/敗訴）的影響因素及趨勢，並讓國內工程界對著作權觀念能有更深一層的認知與了解。 | zh_TW |
| dc.description.abstract | The Copyright Law in Taiwan was revised in 1991. Before the revision, the copyrights related to architectural and civil engineering designs are normally classified into the same category of drawing, graphics, and literals. The disputes associated with engineering design were not serious and the concept of intellectual property right protection was not popular. Due to the accession of Taiwan into WTO and the international participation in Taiwan’s construction, the importance of copyright protection is more important then before and the Copyright Law was revised to cope with the need of the industry.
In this study, the copyright right issues related to engineering design and construction was explored. The court decisions involving copyrights disputes were collected and categorized to analyze the general attitude and recognition of the courts on the related cases. The impact factors and trends on the court decisions were studied from theoretical and practical viewpoints. It is expected this study will help strengthen the knowledge base and develop a common understanding of copyright concept in the engineering community. | en_US |
