    Title: 新建工程建造執照查核缺失要項之探討--以台北市為例

    Abstract: 在台灣,建築師為法定的建築物設計人及監造人,必須經由土地所有權人委託辦理其土地上新建建築物之規劃設計及監造作業,其中當然包含相關建造執照之申請。建造執照之申請多由建築師或其事務所從業人員,依據該土地之區域特性、業主使用需求、並在符合相關建築法令下進行規劃設計後而進行申請。但往往因為規劃設計者對於相關法令認知的缺乏或疏漏,經由現行案件簽證項目抽查作業規定,而造成了申請案件錯誤及違反法令之情事發生,並導致案件申請之延誤或因為重大缺失導致相關技師遭受記點或懲處。 國內已陸續在實施建築師簽證制度與建造執照抽查作業機制,然而抽查結果發現完全符合法規之案件僅6.6%,不符法規之案件卻高達93.4%,可見缺失情況實為嚴重。經本研究以統計方法分析後,發現各類建築物之建造執照申請常犯缺失而導致必須辦理變更設計之主要因子依序為(1)防火區劃、防火構造、(2)樓梯、安全梯、特別安全梯、步行距離、(3)建蔽率、(4)停車空間、裝卸位、(5)行動不便者使用設施等五個主要項目檢討錯誤。 本研究針對各項主要缺失之因子進行相關法令之探討,可協助建築師避免不必要之錯誤而造成記點或懲戒之情事發生,期能提升建築師申請建造執照之品質。此外,本研究亦能告知承包商於工程施作時應著重之細節,以避免因建照抽查未通過而對工程造成之衝擊。 研究成果為:(1)利用案例分析,找尋建造執照案件申請易於出錯之項目;(2)探討各類建築物案件申請造成錯誤之原因;(3)提出相關之防範措施,避免錯誤之發生。 The scale, content, construction requirement, technical management and investment of major public construction works in Taiwan are getting more and more complex. And the construction schedules are more critical than ever. The construction project management in Taiwan has become more difficult. Specifically, the government actively proposed condensed personnel policy in recent years, resulting in the urgent need of professional resources from the private sector to assist in the project management area. Therefore, it will be an inevitable trend for the public sector to delegate the consultant firm to execute the project management works. Therefore, how to improve project management for the consultant firms is an important issue to be deeply investigated.
