當文化異質性隨著晚期現代的全球化快速生產繁衍升高之時,新的排斥操作也正在以各種壓抑、限制、懲罰、污名、貶低、打壓、支配、管制來模塑出馴順的「良好公民」。特別是當性、性別、基本人權在新興網路科技創造的新社會空間和互動機會中逐步發展出了新的交集,新興科技所帶來的開放和流動不但凸顯也挑戰了既有文化對於性、性別、人權的預設時,以兒少保護為主旨的立法與執法也正在對各種和性與性別相關的開拓實踐、不馴實踐、異質主體加以司法壓力。本研究計畫因此將從人文社會研究的視角,針對案件的模式、主體的經驗和感受,細部檢視性/別排斥在這個重疊交會場域中的具體操作,以觀察新興網路科技興起後,出於兒少保護的呼籲,網民的公民權受到何種限縮,其主體性受到何種衝擊。 As late modernity effects increasing heterogeneity through the spread of globalization, new forms of social exclusion are also instituting various kinds of repression, restriction, punishment, stigma, degradation, domination, and regulation so as to shape and produce good citizens. And as new internet technology creates new social space for the interaction among sexuality, gender and basic human rights, it not only brought forth an openness and fluidity that exposes and challenges existing assumptions about and regulation of sex, gender, and human rights, but also chooses to put all explorative practices, non-normative practices, heterogeneous subjects under the auspices of legal prosecution. The present project intends to examine the pattern of the cases under investigation and/or prosecution, to investigate the experience and feelings of the subjects who underwent the process, so as to observe the concrete operations of gender/sexuality exclusion in relation to internet sexual subjects and the retrenchment they suffered in regard to their civil rights and subject formation. 研究期間:9611 ~ 9710
