摘要: | 法實證研究,乃指一種以經驗為主的法律研究方式,透過有系統地觀察、蒐集經驗事實, 並以一定的方法進行分析、詮釋,回答研究者欲探討的問題。我國自2006 年以來,如公法學、 民事法學、醫療法學、刑事實體法學等領域,均已有相當豐碩的法實證成果。然而,在刑事程 序法學領域,卻幾乎完全沒有以法實證研究為主要研究方法的成果產出,導致對於本土刑事程 序的理論與運作,往往欠缺實證面向的瞭解。此種發展趨勢,對於我國刑事程序法學研究與實 務運作之健全,均極為不利。探究法實證研究為何不受我國刑事程序研究者青睞之原因,不僅 有學術上的價值,對於我國刑事程序實務的運作發展也極為重要。 本計畫希望探討的核心問題有二:第一,探究我國刑事程序法學領域,法實證研究成果稀 少的根本原因和限制因素,嘗試汲取英、美百年來研究與實踐的經驗,突破這些限制因素,以 增加我國刑事程序法學領域之法實證研究成果。第二,希望針對我國刑事程序法學領域,建立 法實證研究的方法論,釐清運用法實證方法進行研究的功能與限制,促使刑事程序研究者在採 用實證方法觀察、蒐集、分析、詮釋事實資料時,能注意法實證研究的特性,正確運用實證方 法,使研究成果更有價值。 ;Empirical Legal Studies (ELS) is an approach that seeks to observe, understand, and explain how law works in the real world. Taiwan’s ELS has entered new era since 2006, with the establishment of Taiwan Database for ELS, the first national conference on ELS, and the first publication which introduced the fundamentals and methodology of ELS. Also since 2006, many legal scholars in Taiwan have applied an ELS approach in their own areas of legal studies, including public law, civil law, medical law, criminal law, etc. Criminal procedure, however, is apparently not one of the areas with abundant research in ELS. Instead, there is almost no ELS research in the field of Taiwan’s criminal procedural jurisprudence. The scarcity of ELS in Taiwan’s criminal procedure studies is an unusual phenomenon, compared with studies in other legal fields in Taiwan, and criminal procedure studies in other countries, and this may have resulted in the lack of empirical understanding of Taiwan’s criminal procedures. In order to explore the reasons why criminal procedure scholars in Taiwan have little interest in ELS, this research project will discuss the general functions and limitations of ELS in the studies of criminal procedure, introduce the abundant ELS research on criminal procedure in the U.S. and the U.K., and analyze nine possible causes of the lack of research on criminal procedure ELS, in Taiwan. In addition to figuring out the reasons why Taiwan’s criminal procedure scholars don’t use ELS, this project also aims at establishing an ELS methodology framework for Taiwan’s criminal procedure studies. Through this framework, this research project will not only examine the virtues of ELS, but also set out the potential shortcomings of ELS when applied to criminal procedure studies. In this way, this research project hopes to encourage criminal procedure scholars in Taiwan to better understand and take advantage of ELS in their research. |
