    題名: 大型公共工程招標文件納入時程網圖之研究;A Study on Including Network Schedules into Tender Documents for Large Public Construction Projects

    摘要: 公共工程常見逾期完工的爭議。公共工程委員會每年都有超過百件與逾期罰款相關的調解案,若是加上相關的仲裁及訴訟案,每年就耗費相當大量的社會資源在處理工程逾期相關的爭議。一般各機關的工程履約期限說明皆為在固定的天數(日曆天/工作天)內完工或限期完工,但招標文件中並未說明其訂定工期之由來,如此工期訂定方式常造成工期是否合理的質疑。
    本研究以文獻回顧的方式探討工程逾期發生之原因,並整理目前國內各機關之工程招標文件範本以及時程管理現況,藉由訪談15位目前執行公共工程相關人員(公家機關、營造廠、工程顧問公司、建築師、律師等),進而探討大型公共工程招標文件納入時程網圖之可行性。
    訪談結果顯示,僅有20%的專家認為目前公共工程訂定之工期為合理,且有73%的專家認為,大型公共工程招標文件納入參考性之時程網圖可以提升工期合理性,其納入時程網圖之形式,無論契約金額,以及無論是建築工程或是土木工程,皆建議以納入詳細式邏輯網圖為佳。目前招標文件納入時程網圖最大的困難則為專業人員欠缺,以及工程預算不足之情形。本研究最後於法規面、契約面、執行面提出改善建議,期能對提升公共工程工期合理性與減少公共工程逾期爭議有所助益。
    ;Disputes related to delays of public construction projects occur frequently. There are hundreds of such mediation cases in the Public Construction Committee and also many litigation cases in courts that consume huge amount of social resources in the resolution process. Normally, the duration of a public construction project is regulated by certain amount of working days or calendar days, or by a fixed date before that the project should be completed. However, there are no explanations of descriptions in the tender documents regarding how the duration was determined, which often raises doubts about rationality of the duration.
    This research concluded the reasons that cause project delays through literature review, and summarized contents of current tender documents and regulations regarding schedule management in public construction projects. An expert interview on the feasibility of including network schedules into the tender documents was also conducted. 15 experts were interviewed including personnel in governmental agencies, contractors, consulting engineers, architects, and lawyers.
    Results of the interview reveal that only 20 percent of the experts consider current public construction project duration being reasonable, while 73 percent of them believe that the inclusion of network schedules, in a detailed logic diagram format for all kinds of projects, would significantly improve the rationality of project duration. In addition, the most difficulties in the inclusion lie on shortage of professionals and on insufficient budgets. Finally, this research proposes suggestions from the aspects of regulation, contracting, and execution. Results of this research are deemed useful in facilitating rationality of project duration and reducing disputes of delays for public construction projects.
