營造廠在公共工程在施工時必須依照契約與相關法令規範執行，並需要有良好的管控及協調，才能順利完成。然而實際執行時，契約兩造雙方對於契約及程序大多有著不同的解讀及處理方式，因此經常造成履約爭議，甚至偶有解約的情形發生。對於公部門的業主而言，若有工程發生解約，如何善後或重啟招標大多是一大夢魘。本研究收集近5年公共工程施工解約案例，進行相關原因歸納及特性分析，並將契約執行已超過6個月以上案例與全部案例進行差異比較。在本研究收集的601件案例中，工程類型以建築工程最多，工程規模以一千萬以下最多，機關端則以地方政府居多，營造廠的等級就比例而言，則以丙級最多。期望本研究之成果能做為國內日後防範工程解約可能性之基礎資訊，進而提升公共工程的整體環境。;Construction companies have to follow all requirements from contract and relative rules and specifications to complete a public construction project. Furthermore, they still require good control and coordination capability to complete the project with high performance. However, both of contract parties usually have different interpretation and responses on contract clauses and performance procedures. This not only causes contract disputes but also increases the possibility of contract termination. For the client in public construction projects, if a project encounters contract termination, which definitely is a nightmare to deal with the consequent procedures and retendering works. This research collected the contract termination cases for construction companies in the past five years and analyzed the causes and characteristics of contract termination cases. The cases that contract duration have went over six months before termination are identified and compared to all cases. Among 601 cases, this research found that the majority of project types is “building construction,” the majority of project scale is “less than ten million,” the majority of client is “local government” and the majority of grade of construction companies is “level C.” It is anticipated that the research outcomes could be the fundamental for preventing termination for construction projects and for improving construction environment.
