壽險業屬於金融機構,其資本額已大到足以影響國家金融秩序,而其經營是否穩健,關乎社會經濟問題。保險公司之收入來源大宗是業務員所收入的保費,因此業務人員的管理相當重要。N公司是國內前幾大保險公司,其業務人員勞務契約是僱傭或承攬,一直爭議不休,雖經司法單位多次攻防仍無定論,而其影響勞資關係及公司經營成本甚大,為公司經營的一大隱憂。本文認為,勞動契約應就契約內容的實質權利義務來定義,因此,基於法律的安定性,法院之裁定應儘量統一,以免讓業務員無所適從,並期待立法單位僅速修訂勞動契約法,透過團體協約以確保業員的權益,共創壽險公司與業務員和諧雙贏的局面。;Life insurance companies are financial institutions, they are so large in size that they have a major impact on the financial order and socialeconomic issues. The premium income of insurance solicitors is the main revenue source of an insurance company, the management of them thus is very important.Company A is currently one of the major domestic insurance companies in Taiwan. It has been an ongoing controversy that whether the labor contract is a contract of employment or one for work. This issue is still inconclusive after several turns of accusation and defense in the court, leading to a big concern for business management due to its great impact on labor relation. This study suggests that a labor contract should be defined in terms of substantive rights and obligations in the contract content. In addition, based on the principle of legal stability, court rulings should be as uniform as possible so that they do not bewilder insurance solicitors. Finally, the legislature should amend the Labor Contract Law as soon as possible to ensure the rights and interests of solicitors through collective bargaining agreements, creating a win-win situation for both life insurance companies and solicitors.
