    摘要: 近年來世界各地紛紛受到「全球暖化」和「氣候變遷」之影響,使原本就易受天候 外力影響的營建工程,更容易因為天候與自然災害因素導致工程工期之延宕。但目前工 程契約中,對於因天候與自然災害之影響得以展延工期之規定,並非相當明確;亦即, 受影響的工程項目與可展延工期的條件,契約中並非都有詳細的規定。
    本研究以營建工程中的建築工程為基礎,首先分析建築工程中的常見的作業項目, 並進行相關文獻回顧、蒐集過往工程案例與工程契約條文,針對因天候與自然災害得以 展延工期之約定情況,進行統整分析「天候與自然災害影響工期展延」的類別,以及影 響工程項目之種類與條件;其次尋找從事建築工程相關業務的營造廠商、顧問公司、專 家與機關進行問卷調查,利用問卷之結果與專家進行討論,完成「因天候與自然災害展 延工期之標準」之初步調查,並提出本文之結論與建議。希望透過本研究之成果,降低 因天候與自然災害因素在建築工程工期展延上之爭議。;In recent years, the world has witnessed increasing impacts from global warming and climate change, resulting in construction projects becoming more susceptible to weather forces and vulnerable to delays caused by weather and natural disaster factors. However, existing engineering contracts often lack well-defined provisions for time extensions in response to these factors. This deficiency in contractual clarity concerning the affected construction activities and conditions for time extensions is a common issue.
    This study focuses on building construction projects. Firstly, it analyzes common construction activities in building projects and conducts a comprehensive literature review, incorporating past engineering cases and contract provisions. Secondly, surveys are conducted among construction firms, consulting companies, experts, and regulatory authorities engaged in building construction-related activities. The survey results are subsequently discussed with experts to complete the preliminary investigation of "standards for time extensions due to weather and natural disasters," leading to the formulation of conclusions and recommendations in this thesis. By addressing the identified gaps, this research aims to mitigate disputes related to time extensions caused by weather and natural disaster factors in building construction projects. The study′s findings are anticipated to contribute to improved contract clarity and more effective management of construction schedules under the influence of adverse weather and natural disasters.
