Abstract:	本計畫將探討，在我國憲政架構下，吸取美國、英國與德國經驗，如何兼顧人民訴訟權、正當法律程序、權力分立以及國會調查的效率，尋找可行的強制證人出席與證言的制度。此外，本計畫指出，立法院要強化其自我取得資訊的能力，輔助其職權行使，不一定要訴諸於強制和處罰。德國的資訊性調查委員會並無強制權，與英國的特設委員會無強制出席與處罰權，運作都相當成功。
