Abstract:	本研究計畫將提出企業再生法草案，為臺灣公司重整制度的現代化改革注入新動力。企業再生法草案預計將主要分成一般重整程序以及中小企業特行重整程序，在一般重整程序方面，將以現行公司法重整制度以及司法院債務清理法草案第四章重整章為基礎，並加以更新﹔在中小企業特行重整程序方面，將以美國小型企業重整法（Small Business Reorganization Act,SBRA）為主要參考，設計出適合我國國情的中小企業再生程序。另外，我國將於2025年納入世界銀行2024年全新推出的《經商環境成熟度報告》（Business Ready）評分之經濟體中。其中，企業破產/清理制度（Business Insolvency）為新報告的十項評估指標之一，顯見將來透過企業再生法草案之提出，促進我國企業破產/清理制度的改革，將能夠有效提升我國未來在《經商環境成熟度報告》的評分與排名。
