Abstract:	臺灣地區地狹人多，可利用的土地有限，房價一天一天的漲，因此違章建築孕育而生，從鄉間鄰里到城鄉之間到處充斥著違章建築，其有增生蔓延的特質，所以被稱為「都市之瘤」。其所影響之層面不但涉及公共安全、公共交通及公共衛生等問題，更是城市景觀的殺手。多數民眾認為滿街違章亂象應加以整治，政府機關及專家學者亦呼籥要對違章建築重視及控制。然地方政府亦極力拆除違章建築，維在執行拆除過程中，常面臨各種困難、阻力，例如經費拮據、法令過時、選舉考量、民眾法治觀念不足，以及民意代表的關切與干預等等，常感績效不彰。本研究藉由參考文獻回顧及分析國內處理違章建築現況，進而針對新北市處理違章建築現況分析，並以問卷調查統計方法分析，找出關鍵問題，並嘗試提供最適的對策。本研究寄發問卷調查120份，有效收回為81份，問卷調查包括三大部分：（一）基本資料調查、（二）對違章建築一般調查、（三）對新北市政府執行違章建築調查。綜合問卷調查結果及法令規章之探討，其建議如下：（一）法令之頒修、（二）政策制度方面之改進、（三）執行面之加強。作為新北市政府處理違章建築之參考。The more amount of people live in the narrow land，the less available landscan be used in Taiwan. Moreover, the house price has risen day by day, in thiscase, there are more and more illegal constructions in countryside and urban.The formation of illegal construction is a serious problem ,we called thatphenomenon is the tumor of urban.However , the problems of illegal construction affect many fields , such aspublic security, public transportation ,public sanitation and urban landscape.Most people think government should resolve the problems of illegalconstruction；furthermore, scholars and experts suggest that government shoulddeal with and control the chaos of illegal constructions. However, the localgovernment has been devoted to demolishing the illegal constrictions, but theyface lots of difficulties during the process of demolitions, such as the budget, thelaws, the consideration of election, the concept of the citizens, and theinterference of the elected representatives.According to the literature review and the analysis of the current status ofdomestic illegal construction, the researcher try to analyze the current status ofillegal construction in New Taipei City. The analysis which is be analyzed by thestatistic questionnaire survey method to identify the key issues and try toprovide the solution of illegal construction.This study sent 120 questionnaires, 81available surveys, the survey includethree part:1.basic information survey2.the general survey of illegal construction3.the survey of the implementation.To synthesize the survey results and the analysis of laws, the researchersums up the following suggestions:1.Amending the laws2.the improvements of policy3.to enhance the implementation.
