dc.description.abstract | With the change of world trends, Taiwan is facing the pressure of industrial transformation, and the government has gradually begun to attach importance to the development of cultural and creative industries. The Economic Construction Committee of the Executive Yuan mentioned in the 2012 national construction plan: in response to world trends such as aging population, future energy conservation and carbon reduction, and the rise of creative economy, and accelerate the transformation and upgrading of the industrial structure, the government has selected six major industries such as cultural creativity, green energy, biotechnology, exquisite agriculture, medical care, and tourism as the focus of development. Film, pop music and publishing and other key industries, to create Taiwan′s cultural and creative industry has become an international indicator, the film and television industry is considered to be the leader in promoting the cultural and creative industry, whether the government or private enterprises are very optimistic about the unlimited influence and new business opportunities brought by this industry, how to solve the problem of fundraising, the government has formulated relevant investment and financing policies and mechanisms. However, when it comes to investment between start-ups, cultural and creative undertakings and a small number of investors, it is mainly related to contract law, company law or criminal law derived from fraud, and it is more likely that the act of raising funds from the public may touch on the core of financial legal norms or securities and exchange law and other issues in addition to the aforementioned issues.
