dc.description.abstract | With the complexity of construction projects being increased, disputes are occurred due to uncertainties and various disciplinarians’ different interests. Disputes of construction projects exist ranged from preliminary study, design, contract awarded, and to construction stage of the project. In Taiwan, the court often trusts a third party to appraise the technical evidences or consequences of disputes for its references to judgment.
Due to the lack of standard procedures, most of engineering appraisements are made according to experts’ specific experiences. Therefore, the quality of appraisement varies, and sometimes, similar types of disputes got opposite conclusion. Accordingly, it is important to develop standard procedures for construction technical appraisement.
Construction disputes can be categorized into several types, such as payment, change contract orders, project duration extension, etc. Past appraisements show that several types of disputes may have common causes. Thus, this study analyzes general rules to formulate the appraisal principles to provide reference for person while appraising the engineering disputes.
The principles found in this research have been made a simple comparison with court decision, and the author finds most of the principles have been adopted by the court. That shows the results of this research have contribution to engineering appraisement.
