dc.description.abstract政府每年編列預算興闢公共建設,舉凡排水、道路、公園、宣導政令的電子看板、補助照明的路燈、綠美化的行道樹等公共設施,種類繁多,且完成時間與使用狀況皆不同,故其維護、維修工項繁多,而且作業時程及數量不確定,若依狀況需求逐案依公務程序與政府採購法辦理維護、維修等作業,恐承辦機關將耗費相當多的人力、物力、時間,而達不到應有之效果,另如有災害緊急搶修及搶救等即時處置需要時,若透過政府採購法辦理往往失其時效,所以管理執行機關常為民詬病有維護效率不彰情形發生。 因此政府機關尤其基層鄉鎮市公所為解決作業績效與效率問題,就將常態性小型工程、年度計畫工作及經常性的維護、維修等工作以開口契約方式來尋求承商辦理,然開口契約與傳統契約有不同之觀點與目的遂有契約管理、工作品質、業主與承商權益問題之衍生,因目前無開口契約之範本,機關皆以傳統契約之範本為基礎補以本身經驗及觀摩別機關之作法來管理與執行開口契約作業。 因此本文透過契約資料的搜集,並補以中壢市公所在開口契約之應用及本身工作經驗與訪談承辦人員及承商就開口契約相關之問題,提出對策,供有關人員參考。 zh_TW
dc.description.abstractThe government provide budget to build public construction every year. For instance, drain facilities, road, park, Electron billboard, Street lamps, Way trees in the line and etc. There are all kinds of public construction s, and it is all different that using condition and completion times. Organization needs plenty of time, Manpower, and material resources to do the maintenance work by official business procedures, and Government procurement laws. And it could not attain effect. When there is a need of urgent repair and rescue. It will waste time by using Government procurement laws. There will happen the shortcoming of efficiency of maintain in Management of the executive organ. Therefore , Municipal township in order to solve the problem of operating performance and efficiency, it will be the norm of small-scale projects, annual work plans and regular maintenance, maintenance contracts and etc to seek contractors by using indefinite delivery contract .There are different point of view and purpose in indefinite delivery contract and traditional contract such as Contract Management , Quality work and the problem between owners and contractor. The Management of the executive organs by using the experience, to observe other executive organs and traditional template to perform the indefinite delivery contract because there doesn’t have the template about indefinite delivery contract. Therefore, this article gathering the contract information and using the application of indefinite delivery contract in Jung-Li City Hall with my working experiences to provide countermeasures in order to solve the problem and provide associated personnel to consult about indefinite delivery contract. en_US
