機關辦理勞務採購，須受採購法的規範，執行委任律師過程並不例外。當採購金額達公告金額以上，則必須依照規定之採購模式執行。由於採購程序的繁冗，對於遭遇特殊情況之專案，將產生其委任過程是否符合時效之問題，也易造成機關常透過某些手段，迴避採購程序。同時，機關於執行委任律師過程中，甚少採用最有利標之評選機制決標，而大多採最低標決標，易於忽略履約品質，或履約內容不符交易慣例，或給予之服務費用偏離市場行情，造成劣幣驅逐良幣情況。 為此，本研究藉由文獻探討、政府採購法之分析和專家座談，整理出律師委任過程中可能的問題，將其彙整成三大議題，分別討論為：(一)最適採購模式之選用、(二)評選/評估項目之建構、(三)律師委任契約之要點。本研究將既有採購行為重作組合，提出七種採購模式，探討各模式間之異質性、時效性、夥伴關係、價格因素等影響特性，並分析不同的法律服務類型的影響特性，在符合法制的規定下，建議適合於不同類型的聘用模式。另外也運用AHP建構了評選/評估法律服務案件的評審項目及其權重，冀望提升機關採用評估機制的意願。且提議適合於委任律師契約之要點。藉此提供主辦機關在聘用律師時，可遵循執行之參考依據，改善目前國內律師委任過程所遭遇之問題。 It is necessary for the government agency to employ all kinds of service according to the procedures specified in Government Procurement Law (GPL). The employment of legal services is not an exception. The specified procedure may need longer time than allowed and thus creating prescription difficulties in following the procedures. On the other hand, a good number of the legal service contracts were awarded through Lowest Bid mechanism, which has led to risks related to low quality services. In this study, the procedures related to employment of legal services are studied and three major issues are analyzed: （1）The most suitable procedures could be used in various conditions, （2）The items of consideration when awarding a legal service contract, （3）The major items need to be included in a legal service contract The heterogeneity, prescription, partnership, and compensation related to the procurement of legal services are studied and analyzed. Seven procedures are summarized and proposed for use for various conditions. Analytical Hierarchy Process (AHP) is adopted to analyze the major factors and weight to be considered for awarding legal services contracts. The result could be a good reference for the engineering agencies when utilizing Most Advantageous Tender mechanism. Major items of contract term are also studied and summarized to provide assistance to the engineering agencies for drafting contracts.
