    Abstract: 大型工程專案所需文件種類及數量龐大,從業主所需之施工進度表、每次會議紀錄、需求說明書、工程變更相關資料;承包商所需要的自主檢查表、進度表等,還有建築師所需要的監工日報表等,甚至還有下屬小包亦有相關文件呈報。數量及種類龐大複雜,管理十分不易。而調解、仲裁、甚至是訴訟等解決工程爭議之方式,往往因工程專案時間過長、各界面整合困難、文件傳送方法及格式不一,造成承包商無法適時提出必要之證據證明而敗訴。平時各工地所使用之文件管理,大多為利用時間與種類作為兩座標軸之配合處理,但往往因此造成繁複以及龐大的結果。而如有使用專案文件管理系統者,也往往缺乏了對於工程爭議方面之配合。 本研究藉由重新整理工程爭議、蒐集一工程專案所需之文件、釐清事實問題與法律問題後,使用案例分析法,找出於各項工程爭議發生時,各項文件之證據效力性,進而設計此ㄧ系統。期許各專案於實行時,能因使用此文件管理系統紀錄各項文件,達到文件管理方便及快速化之效用外,並於爭議發生時將已紀錄之文件做好爭議類型分類,而各爭議種類中亦已有具證據力之文件表單,使日後發生工程爭議時可藉由系統之紀錄提出證據效用,加強工程爭議時承包商提出證據效率性與效力性,節省提出文件時之時間與金錢,確實達成勝訴之效果。 In large construction projects, the amount of documents is massive. This causes management of construction disputes a very difficult issue. Often, the contractor did not realize the importance of documentation, until very late in the construction stage, only to find out that the needed piece of document had been missing. To properly administer those documents which are produced daily on site, in headquarter and in all channels of communication in the forms of paper or oral records, site management must be equipped with a computerized platform which integrates the process of procurement, site management, materials management, etc. This work aims at devising such a system. The idea is to employ the benefit of web-based software and search engine for delivering a responsive tool to be implemented be site management. The system also divides the subsystems according to the type of construction disputes, making use of the characteristics of each type of disputes. With thorough interviews input from industrial wachitioners, the proposed system can encompass all major forms of construction documentations. Its major contribution is to alleviate the burden of site management in resolving construction disputes and to minimize the cost of disputes management.
