    摘要: 考試院為因應行政革新,於民國99年4月份完成公務人員考績法修正草案,並函送立法院審議,以落實獎優汰劣之考績目的,對不適任者建立起一退場機制。惟該修正草案有影響公務人員權益之疑慮,故本研究即以該考績法修正草案下,公務人員年終考績考列丙等,所造成對該受考者之基本權之影響,法律上之爭議與權益侵害問題,並對如何強化及保障其基本權利進行檢討。 本文從基本權保障之角度分析,肯認新制實施後考列丙等年終考績將造成公務人員服公職權利之侵害,因此繼而從法律明確性原則、比例原則以及平等原則,檢討其是否具備憲法上之正當化基礎。再來則是對考績評定程序中受考者程序保障之檢討。應如何強化受考者程序權,才能對其權益提供完整之保護,並使服務機關所為之考績能公平客觀。接下來,本文對於新制下考列丙等考績之受考者,該如何給予應有之救濟途徑,並就司法院大法官解釋及公務人員保障暨培訓委員會之相關決定,予以分析。檢討考績新制下受考人不服考列丙等之救濟途徑選擇,受考人在救濟程序中所應享有之程序保障,以及公務人員保障暨培訓委員會對於考績評定決定之準司法審查密度問題。 茲此,本文將總結以上之結論,俾提供日後考績新制運行後,能對新制下受考列丙等之公務人員,所產生之爭議有所助益,並提出我國未來針對考績新制之法制規範所應興革之建議。 Examination Yuan in response to administrative reform in April 2010 to complete the draft amendments to Civil Service performance appraisal method, and send to Legislative Yuan for deliberation, to implement the award of the superior and eliminating the inferior performance purposes, does not apply to any person erected an exit mechanism. But in this way affect the draft amendment concerns the public service interests, so this study is to draft amendments to the appraisal method, the Civil Service test column C rating year-end performance, caused by the examination of the impact of those basic rights, legal disputes rights violations and issues, and how to strengthen and protect their fundamental rights review. This article from the perspective of protection of fundamental rights, admits the new system after the implementation of C rating performance will result in the rights of public servants against the public service, it followed from the principle of legal certainty, proportionality and the principle of equality, whether they have the constitutional review of justify the foundation. Again it is the performance assessment process by the procedural safeguards reviewed. How to strengthen the program by the persons the right to provide complete protection of their rights and interests, service authorities and to whom a fair and objective appraisal. Next, this new system under test for the performance of the column C rating by the test person, the way how to give proper relief, and to explain the Grand Justices, and the Civil Service Protection and Training Commission of the relevant decisions to be analyzed. Review performance against the new system under test by the test person's relief column C rating channel selection, by examination relief program in the program should enjoy protection, and Civil Service Protection and Training Commission for performance assessment of quasi-judicial review of the decision of the density problem. Hereby, this article will summarize the conclusions above, serve to provide future performance running the new system, under the new system be able to test out C rating of public servants, the dispute arising helpful and made our future the new system of legal norms for the performance should reforms and the recommendations.
