國內研究以傳統工程履約爭議(即:變更設計、估驗計價、材料物價指數變動等)為主,尚無針對指定分包方面契約的探討,因此本研究以相關文獻資料作為理論基礎,透過問卷調查方式解析業界採用指定分包契約之情況,並探討目前業界上使用遭遇之相關問題,其結果顯示:指定分包契約易使業主、營造廠及指定分包商對於契約規定之施工界面要求、施工數量等產生認知上差異衍生履約爭議,故相關人員於履約階段可透過清圖方式,並定期或不定期以召開三方(業主、營造廠、指定分包商等)會議方式來檢討解決爭議,以利確保工期及施工品質;本研究最後並透過彙整問卷調查、個人實務心得與業界、學者學者意見,針對契約範本中相關條款增修方式,以提供解決目前業界民間工程對於指定分包契約資料不足之制定契約資料參考,並期使能確實發揮指定分包契約精神。; Domestic research in traditional construction contract dispute ( ie : Change the design, assessment testing pricing, changes in materials price index , etc. ) based, yet to explore areas for a given sub- contract , so this study the relevant literature as a theoretical basis , through a questionnaire investigate ways to resolve the situation using the industry 's nominated sub- contract and explore the use of experience on the industry 's current issues , the results show : easy to make the owners of the nominated sub- contract to create plants and subcontractors specified requirements of the construction contract for the interface requirements , construction quantity cognitive differences arising on derivative contract dispute , the relevant personnel in the compliance phase diagram can be cleared through regular or irregular manner and to convene a tripartite ( owners , to create a factory, designated subcontractors , etc. ) meeting to review ways to resolve the dispute, Lee ensure that the duration and quality of construction ; Finally, this study compiled through questionnaires , personal practical experience with the industry , academics and scholars comments relevant model contract terms for upgrading way to provide solutions to the current civil engineering industry subcontract insufficient information for the specified the contract to develop reference data and do play the specified period to enable subcontract mental .
