摘要:	2001 年行政院客家委員會正式成立，正逢我國政府推動「業務委託民間辦理計畫」，客委會歷年採購契約數量，有逐年增多之趨勢。2007 年新北市客家事務局成立，旗下舉辦之客家相關活動也走向委託民間辦理途徑進行。本研究以新北市義民文化節為例，從政府方、代理方與參與方三方的角度來探討新北市客家義民文化節活動中，新北市客家局與承包商的互動關係，以及參與民眾的觀感。研究發現，新北市客家局在監督及驗收時，以契約文字為標準，契約未規範之範圍，難以要求廠商配合；承辦人員專業能力若不足，控制權容易落入廠商手中。現有之政府採購法，對文化型勞務委外之規範，尚有不足之處，容易導致服務物化與量化，對於核心價值，如民眾滿意度、目標之達成，缺乏明確審核標的。義民祭活動的經費隨著活動擴大而增加，客家社團雖具備深厚客家知識背景，卻因不具備招標、企畫、辦理大型活動等專業能力，無法與公關公司競標，合理爭取經費。前來參與義民祭活動的民眾，除了參與祭祀之目的外，更期待能藉此活動提升客家能見度、達到客家文化往下傳承之目標。本研究建議，政府可以開辦專業課程，扶植社團人才；辦理承辦人員專業訓練、建立相關廠商資料庫；擬定適用法規，採行分項委外，專業分工。承包商辦理活動時宜增加宣傳，選擇室內外兼具的場所，規劃更具客家代表性、吸引年輕族群的活動。客家社團可以共同成立義民祭典組織，由此常設的義民祭典組織向政府投標義民祭典活動。 ;After Hakka Affairs Council (HAC), Executive Yuan was formally established in 2001, Taiwan government was promoting “Outsourcing Promotional Services.” Since then, the number of procurement contracts of the HAC has increased year by year. In 2007, Hakka Affairs Department (HAD), New Taipei City Government was established, and the Hakka-related activities it held were also outsourced. This study takes Yimin Cultural Festival in New Taipei City for example to investigate the interactive relationship between Hakka Affairs Department and contractor, as well as the perception of participants in the activities of Yimin Cultural Festival in New Taipei City, from the perspectives of three parties – government, contractor, and participants. This study found that, during the supervision and acceptance inspection, Hakka Affairs Department, New Taipei City Government used contract content as the standard. It was difficult for Hakka Affairs Department to request contractor to cooperate with it for the scope that is not stipulated in the contract. If the professional competence of undertaker is insufficient, contractors may easily take control of the situation. The existing Government Procurement Act cannot fully regulate the outsourcing of cultural activities, which may easily lead to the materialization and quantization of services. There is a lack of specific target of review on core values, such as the public’s satisfaction and objective fulfillment. With the expansion of activities, the expenses of activities of Yimin Festival have increased. Although Hakka associations are rich in Hakka knowledge, they do not possess the professional competence to invite public bidding and plan and organize large-scale activities. They fail to compete for bidding with PR agencies to strive for rational fund. In addition to participating in worship, the public attending the activities of Yimin Festival also intend to improve the visibility of Hakka and achieve the objective of inheritance of Hakka culture through such activities. This study suggests that the government should hold relevant professional courses to cultivate professional talents in associations. The government should also provide undertakers with professional training and establish relevant contractor databases. Applicable laws and regulations should be formulated and sub-tender should be adopted to independently invite public bidding for core Yimin worship and Hakka cultural inheritance items. When organizing activities, contractors should increase propaganda, choose the venues with both indoor and outdoor spaces, and plan activities with more representative Hakka features to attract younger population to participate in them. Hakka associations can jointly establish a performant Yimin Festival organization to submit tenders to government’s Yimin Festival activities.
