關鍵字:大陸配偶、大陸學生、社會保障、社會救助、社會保險、新住民發展基金、全民健保 ;ABSTRACT The theme of this dissertation is to discuss the social security of people of the Mainland Area in Taiwan and to take Chinese spouses and students from Mainland China as the main research object. The author first explored the legal status of people of the Mainland Area. After that, the author examined the differences between Chinese spouses and foreign spouses in obtaining national ID card of R.O.C. and applying the laws and regulations of public assistance and social insurance. The author hopes to clarify the status of Chinese spouses in Taiwan through the inventory and arrangement of relevant laws and regulations. The author continued to explore the current situation of students from Mainland China in Taiwan and related policy proposals, including the differences between degree students and non-degree students, the situation of people of the Mainland Area joining the National Health Insurance(NHI) and the reasons for approving or opposing students from Mainland China joining the NHI. After examining the relevant laws and regulations applicable to Chinese spouses and students from Mainland China, the author reviewed several sections, including whether the people of the Mainland Area could advocate the constitutional fundamental rights and the constitutionality of the differential treatment that Chinese spouses faced by. As for students from Mainland China, the author reviewed the differences of the rights in Taiwan between students from Mainland China, students from Hong Kong, Macau, overseas Chinese students and international students and the constitutionality of the differential treatment that students from Mainland China are unable to join the NHI. Finally, the author drew a conclusion and made relevant legislative proposals hoping to improve the rights of people of the Mainland Area in Taiwan.
