摘要: | 安養信託是一種財務管理工具,主要用於確保高齡者或需要長期照護的人能夠穩定運用資產,保障生活品質。透過信託制度,委託人將財產(如現金、不動產、保單等)交由專業金融機構管理,並根據事先訂定的條件支付給受益人,以應付日常生活、醫療照護及其他必要開支。這種制度的優點在於,能夠防止財產被不當使用或遭受詐騙,同時確保長期照護需求不受資金短缺影響。 此外,安養信託也可以與遺產規劃結合,確保資產依照委託人意願傳承,減少家族糾紛。適合設立安養信託的人包括高齡者、身心障礙者、擔心財務管理能力下降或希望確保未來生活無虞的人。設立過程通常包括選擇信託機構、決定信託財產、規劃資金運用方式並簽訂契約,後續可依需求進行調整。雖然安養信託需要支付一定管理費,但其帶來的財務安全與生活保障,使其成為許多人規劃晚年生活的重要選擇。 本論文以安養信託制度為研究核心,特別關注受託人的照護義務。隨著全球高齡化趨勢加劇,如何保障老年人的財務安全與生活品質成為重要課題。信託制度作為財產管理與規劃的重要工具,在安養信託的發展中扮演關鍵角色。然而,目前我國安養信託制度主要集中於資金管理,對受託人是否具有照護受益人生活起居的義務尚未有明確規範。本研究試圖探討受託人的照護義務是否應被納入法規,並對比日本、英國、美國等國的相關制度,尋找可能的立法借鏡。 ;Elderly care trust is a financial management tool primarily designed to ensure that elderly individuals or those requiring long-term care can effectively manage their assets and maintain their quality of life. Through the trust system, the trustor entrusts assets (such as cash, real estate, insurance policies, etc.) to professional financial institutions, which manage and disburse funds to beneficiaries based on pre-agreed conditions to cover daily living expenses, medical care, and other essential costs. The advantage of this system is that it prevents the misuse or fraudulent appropriation of assets while ensuring that long-term care needs are not affected by financial shortages. Additionally, an elderly care trust can be integrated with estate planning to ensure that assets are inherited according to the trustor’s wishes, reducing family disputes. This paper focuses on the elderly care trust system, with particular emphasis on the trustee′s duty of care. As global aging trends intensify, ensuring financial security and quality of life for the elderly has become a crucial issue. The trust system plays a key role in asset management and planning, making it an essential mechanism for elderly care trusts. However, in our country, the current elderly care trust system primarily focuses on financial management, and there are no clear regulations regarding whether trustees are obligated to provide personal care for beneficiaries. This study aims to explore whether the trustee’s duty of care should be incorporated into legal regulations by comparing relevant systems in Japan, the United Kingdom, and the United States to identify possible legislative references. |
