    Title: 我國學生權利救濟制度研究;A Study on Students’ Rights Relief System in Taiwan

    Abstract: 訴訟權為憲法第16條所保障之基本權利,「任何人」均享有且不得任意剝奪,據以回復與修補權利被侵害的缺口,使其他基本權利能被真正行使。然而我國過去將學生被視為特別權力關係中之相對人,或以學生欠缺基本權主張能力為由,以判例或大法官解釋,進行不同程度的限制,如今透過司法院大法官釋字第784號解釋,似使學生脫離特別權力關係,獲得行使訴訟權之機會。
    而依據一般行政爭訟法理,具有權利或法律上利益者,係有權利保護必要,得依權利侵害來源,提起相應行政爭訟程序;至於在學生案件中,是否有所不同,則有深入討論之必要。因此本文透過文獻分析法及法學解釋方法釐清相關爭點,發現學生亦享有訴訟權,若其權利或法律上利益受侵害時,得循相應行政爭訟程序進行救濟,最後,本文提出一套審查流程:?特定校園爭議、?找尋涉及學生權利或法律上利益、?定性其侵害來源之性質及?找尋相應之救濟程序,可以提供未來學生爭訟案件判斷時之參考。;Litigation right is a fundamental right guaranteed by Article 16 of the Constitution of the Republic of China, which everyone has and shall not be arbitrarily deprived of, so as to restore the breach of right and let other fundamental rights be truly exercised. However, in the past, students were restricted to different degrees by legal precedents or judicial interpretations on the grounds that students were regarded as the counterparts in the special authority relationship or that they lacked the ability of claiming they had fundamental rights. Now, through Judicial Yuan Interpretation NO. 784, it seems that students are separated from the special authority relationship and are given the opportunity of exercising their litigation rights.
    Based on the legal principle of administrative litigation, it is necessary to protect those people who have rights or legal interests. They can initiate appropriate administrative litigation procedures according to the source of the infringement. As for whether there is a difference in students’ cases, it is required to discuss in depth. Therefore, this study clarified relevant disputes by using document analysis and legal interpretation and found that students also have litigation rights. If students’ rights or legal interests are infringed, they can be remedied through proper administrative litigation procedures. Finally, this study brought up a set of review process, hoping that it can be a reference for judging students’ cases in the future: (1) specify a campus dispute, (2) find things involved in students’ rights or legal interests, (3) determine the nature of the source of infringement, and (4) find appropriate relief proceedings.
