    Abstract: 政府採購法第一百零一條訂定廠商有違法或重大違約情形時,經異議及申訴之處理程序後,視其結果刊登於政府採購公報,並禁止其一定期限內不得參加投標、作為決標對象或分包廠商等選擇締結契約對象,以杜不良廠商之違法、違約行為,避免其再危害其他機關,建立廠商間之良性競爭環境。該法條第一項第十款及其施行細則針對「延誤履約期限,情節重大者」條文予以定義,明確定義承包商得依循監造人員依法行政之履約進度標準。 若承包商發生可歸責於己事由,未能依照預定之工程進度施工而遲延,則甲方除可依政府採購法懲處外,另依工程契約及民法之規定,亦可對廠商追究責任。可見進度之計算方法對承包商權益影響深遠,然而目前卻無明確規範。因此,本研究擬針對此問題深入探討。 本研究蒐集常見之進度計算方法,予以分類與討論其優缺點,並提出適用工程特性之方法,再兼論履約遲延爭議之實質損害與影響,以建議公共工程採購具備合理基礎之進度計算方法,解決採購機關空有進度標準卻無認定進度計算法則,而存在之爭議與矛盾,避免監造人員陷於嚴酷執行契約或放水之兩難,並可引導承包商循進度計算方法執行進度控管。 A contractor that fatally breaks regulations or contracts according to the article 101st of the Government Procurement Law is forced to prohibit from awarding public construction works in the future. This is to compel inferior contactors in order to protect government bureaus and quality of infrastructure; in the meantime, identification of the agreed calculation method of scheduling in a contract is one of the most causes triggering if the contract or regulations are broken. In practice, it is also ambiguous to select a suitable scheduling approach for both parties in a construction project. The objective of this research is to build up a referable chart that lists suitable scheduling approaches for each category of public construction projects by literature review and case investigation. Analyzing intensely in all collected cases caused by differential recognition of both parties drove to the core of the study. By using the referable chart, conflicts and damages to both parties in a public construction project are expected to moderate.
